Consent to Operate (CTO)

Consent to Operate (CTO) is a legally mandated environmental authorization required for industries, healthcare facilities, and infrastructure projects to commence or continue commercial production and operations.

Under the Water Act (1974) and Air Act (1981), a CTO ensures that a facility adheres to pollution control standards. Today, most Indian states require an integrated digital application process through the SPCB/PCC portals.

In mining, too, CTO means Consent to Operate. A mine or a mineral processing unit needs CTE and then CTO from the State Pollution Control Board, usually after it has received environmental clearance under the EIA Notification. Mining and ore beneficiation is in the red category, so the board inspects before granting consent and attaches conditions on dust control, water use, mine drainage and the overburden. Stone crushers and brick kilns have their own consent conditions and siting rules.

The Consent to Operate (CTO) is the final regulatory seal of approval required under the Water and Air Acts. It serves as an official verification that your facility has been built according to environmental standards.

A CTO certificate is the consent order issued by the State Pollution Control Board (or Pollution Control Committee in a union territory) allowing a unit to operate. It lists the products and capacity, the permitted discharge and emissions, monitoring and reporting conditions, and the validity. The unit must follow these conditions and file the returns the board asks for; operating without a valid CTO can lead to closure orders and prosecution.

To ensure a "First-Time-Right" application, the following documents are essential:

• Proof of Investment: Chartered Accountant (CA) certificate showing the Gross Capital Investment.
• Technical Layout: Detailed Site Plan and Building Plan showing the location of the plant and machinery.
• Environmental Infrastructure: Detailed reports on Effluent Treatment Plants (ETP) and Sewage Treatment Plants (STP).
• Process Flow: A step-by-step description of the manufacturing process with a mass balance chart.
• Analysis Reports: Recent air, noise, and water quality reports from a board-recognized laboratory.
• Land Ownership: Rent agreement or Lease deed.

As an expert, I recommend a proactive approach to the application:

1. Site Inspection & Gap Analysis: Before applying, conduct an internal audit to ensure all CTE conditions are met.
2. Online Submission: File the application through the Integrated Day-to-Day Operation and Administration (OCMMS) portal of the respective state.
3. Site Visit by Board Officer: A Regional Officer (RO) will visit the site to verify the installation of pollution control devices.
4. Trial Run Data: Submit performance data from trial runs to prove the machinery meets discharge standards.
5. Review Committee: For 'Red' category industries, the application is reviewed by a technical committee before the final grant.

The timeline varies significantly based on the category of the industry:

• White Category: Usually 7–15 days (mostly self-declaration).
• Green Category: 30–45 days.
• Orange Category: 60–90 days.
• Red Category: 90–120 days.

While the list is exhaustive, the State Pollution Control Board (SPCB) categorizes industries based on their Pollution Index (PI). Key products and sectors include:

• Manufacturing: Chemicals, Pharmaceuticals, Textiles, Cement, and Steel.
• Infrastructure: Real Estate projects, Hotels, and Hospitals (especially for bio-medical waste).
• Processing: Food processing, Leather tanning, and Milk bottling plants.
• Energy & Mining: Power plants, Mining activities, and Stone crushers.
• Waste Management: E-waste dismantling, Plastic recycling, and Hazardous waste treatment.

Industries are grouped by their pollution potential:

• Red: highly polluting, such as chemicals, pharmaceuticals, tanneries, distilleries and mining. They need consent and the strictest scrutiny.
• Orange: moderately polluting. They need consent.
• Green: lightly polluting. They need consent, usually with longer validity and a simpler procedure.
• White: practically non-polluting. They are exempt from consent and only need to inform the board.

The government fees for CTO are not fixed; they are calculated based on the Total Capital Investment (TCI) of the project and the industry category.

• Administrative Fees: Paid directly to the SPCB via online payment gateways.
• Consultancy Fees: Varies based on the complexity of the project and the technical reports required.
• Testing Fees: Costs associated with third-party laboratory analysis of air and water samples.

A CTO is not a lifetime permit. It requires periodic renewal to ensure ongoing compliance:

• Red Category: Valid for 5 years.
• Orange Category: Valid for 10 years.
• Green Category: Valid for 15 years.
• Renewal Protocol: You must apply for renewal at least 60 to 90 days before the expiry of your current consent. Delay in renewal can result in a "Consent Refusal" or "Penal Fees" (often 50% extra).
