EPR for battery waste will be a regulatory requirement under the rules of Battery Waste Management 2022 in India. Accordingly, manufacturers, importers, and brand owners of batteries will collect responsibility for the environmentally sound management of waste batteries at end-of-life. The Ministry of Environment Forest and Climate Change has come up with the Battery Waste Management (BWM) Rules notified on 22nd August 2022, due to which every producer and any person or entity manufacturing the battery shall have to get registered with the Central Pollution Control Board. Producers and manufacturers of batteries need to register.

Who Can Apply for This Certificate
The following can apply for EPR battery waste certification:
1. Producers: Producers are organizations that produce, sell or distribute batteries and battery containing products.
2. Importer: The importers are liable for the disposal of battery waste, produced by imported items from other countries.
3. Assemblers: Assemblers, who import battery cells and assemble them into final products or devices.

5. Bulk Consumers: Large organizations, governmental agencies, and industrial businesses that use huge quantities of batteries fall in this category.
6. E-Waste Producers: For Battery-Containing Products - Those manufacturers who produce or sell the electronic products that contain batteries like mobile phones, laptops etc.
7. Authorized Representative: For foreign producers or importers, an Authorized Indian Representative can be designated to take care of EPR compliance and obtain authorization on behalf of a foreign entity.
List of Documents Required
1. Company Registration Documents, Certificate of incorporation/registration of the company, PAN card of the Company, GST registration certificate, Company Proof of Address (Utility bill, Rental Agreement etc.).
2. Authorized Signatory Documents: Letter of authority from the company stating the one signatory authorized to handle the application for EPR.ID with the authorized signatory, like an Aadhar card, passport or voter ID.
3. Extended Producer Responsibility (EPR) Plan: An EPR program that outlines the strategy on waste battery collection, storage, recycling, and disposal for the company.
4. Information on Batteries and Products Containing Batteries: Product listing with the information of types of battery used, say, Lithium-ion, Lead-acid, etc.Number of batteries sold in the last financial year, Technical details and safety features of the batteries
5. Manufacturer/Importer License: Offer the import/export code certificate for the importers, For manufacturers, present the factory license or other applicable manufacturing licenses.
6. Collection, Recycling, and Disposal Partnership Agreements: MoU or agreements with licensed collectors and collectors' agencies,Agreement with PROs (Producer Responsibility Organizations), if applicable,Certification of any acceptable recyclers with which the company is engaging to recycle waste of batteries
7. Collection System Evidence: Details and proof of an existing or proposed collection mechanism-whether reverse logistics for take-back schemes
8. Annual Sales and Waste Projections: The probable sales of the batteries one year from now and the Number of spent batteries to be recovered.
9. Recycling Process Process: Recycling plan for the collected batteries, including the recycling process and environmental safeguards, Agreements with licensed battery recyclers
10. Environmental Clearance (if applicable):If the firm has its own recycling or disposal facility, provide the environmental clearance certificate issued by the concerned authority.
11. Declaration: Self-declaration or affidavit stating compliance with the Battery Waste Management Rules, 2022, and other related environmental laws and regulations.
Process to Apply
Step 1
Document collection and preparation for the EPR application:
This Process includes the collection of all necessary documents for the filling of application.
Step 2
Registration on the CPCB Portal and Filing of Application
Post the collection of necessary documents the next step is to register on the CPCB EPR portal along with the filled form and Payment of the government fees applicable.
Step 3
Liaison with CPCB:

Step 4

automotive purposes.
Timeline
Processing time for EPR: it takes a minimum of a few weeks to get extended producer responsibility battery waste EPR certificate, and actually it depends on the overall complexity of your business functioning, the completeness of papers submitted, and efficiency. Usually, the whole cycle for EPR Battery waste takes 6-8 weeks, depending on the document used, compliance documentation, the nature of the application.

What does EPR target for Producers/Manufacturers?
EPR Targets: This is the quantum of Battery that is introduced by producers/Manufacturers to the market. Schedule II of the Battery Waste Management Rules, 2022.
Who all fall within the definition of 'Producer'?
'Producer' means any person who carries on:
Is the registration given by the CPCB to the importers of lead acid batteries valid in the light of Batteries (Management and Handling) Rules, 2001?
The importers must seek fresh registration from CPCB for undertaking any import operation pertaining to battery as well as equipment containing battery.
In case of Proprietorship/Partnership Details to be added under company details in PAN-
An authorised person must be provided with a PAN.
Does new Batteries Waste Management Rules 2022 make a battery user or consumer liable to submit the return on annual or half yearly basis?
Consumers/users of battery are not liable for filing annual or half-yearly returns. However, when any brand/company/industry/User is importing any battery meant for in-house usage, the same will be liable for getting registered with CPCB and they will be subject to EPR obligations; in this case, they will become liable for submitting annual return by 30th June.
Are we at XYZ company involved with Refurbishment of Battery? After refurbishing do we sell the battery after our own brand name? Do we have EPR liability?
If company is refurbishment unit and it sells a battery under the company's brand name then according to rules they would be termed as 'Producer'. They will need to be registered with CPCB and will have EPR liabilities.
