Indian Compliance
CTO Certificate Full Form: Consent to Operate Meaning, Process & Validity (UPPCB)
If you are setting up a factory, a hospital, a hotel or almost any business that discharges effluent or emissions, you will need a CTO certificate before you start operations.
CTO stands for Consent to Operate. It is the permission issued by the State Pollution Control Board under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. It confirms your unit has the pollution controls the board requires. In Uttar Pradesh, CTO is issued by the Uttar Pradesh Pollution Control Board (UPPCB).
CTE vs CTO
| CTE (Consent to Establish) | CTO (Consent to Operate) | |
|---|---|---|
| When | Before construction or expansion | Before starting production, after the unit is built |
| What the board checks | Site, process, proposed pollution controls | Installed effluent treatment, air pollution controls, compliance with CTE conditions |
| Validity | Until the unit is set up, within the time allowed | Set by category and state practice (see below) |
You cannot skip CTE and go straight to CTO for a new unit. Expansion or change in product mix also needs fresh consent.
Who Needs a CTO?
Industries are grouped by pollution potential:
- Red: highly polluting, such as chemicals, pharmaceuticals, tanneries and large thermal plants
- Orange: moderately polluting, such as many engineering and food processing units
- Green: low polluting, such as some assembly and packaging units
- White: practically non-polluting. Exempt from consent, but must inform the board
Hospitals, hotels, large buildings and commercial establishments may also need consent depending on their size and discharges.
CTO Validity
UPPCB has historically granted CTO for fixed periods by category:
- Red: 5 years
- Orange: 10 years
- Green: 15 years
In January 2026, a central amendment changed this: consent to operate can now remain valid until cancelled, as long as the unit stays compliant and files its returns. The same amendment set a 90-day processing time for Red category applications. States are aligning their procedures, so confirm the current UPPCB position for your unit before you plan renewals.
Documents Required
- Copy of CTE and compliance with its conditions
- Proof of ownership or lease of the premises
- Site plan and layout showing treatment units and stacks
- Process flow chart with raw materials and products
- Water balance and details of effluent treatment
- Details of air pollution control equipment and stack heights
- Hazardous waste details, where applicable
- Capital investment certificate from a chartered accountant
- Company registration, GST and authorised signatory documents
UPPCB Consent Fees
The fee depends on the capital investment of the unit (land, building, plant and machinery) and its category. Water and air consent fees are calculated separately but applied for together. Use the fee calculator on the UPPCB or Nivesh Mitra portal, or ask us for a calculation.
How to Apply for CTO in UP
- Confirm the category of your industry.
- Check CTE compliance, especially treatment units and stacks.
- Apply online on Nivesh Mitra, the UP single-window portal, which routes the application to UPPCB.
- Upload documents and pay the fee.
- Site inspection by UPPCB officers, especially for Red and Orange units.
- Answer queries and submit any extra information.
- CTO granted with conditions you must follow.
After You Get the CTO
- Follow every consent condition, such as discharge limits and monitoring
- File annual environmental statements and returns as required
- Get prior consent for expansion, new products or process changes
- Keep monitoring records ready for inspections
Common Mistakes
- Starting production before CTO. This can lead to closure orders and environmental compensation.
- Wrong category. It changes fees, validity and inspection.
- Weak water balance. Numbers that do not add up are a common reason for queries.
- Ignoring consent conditions. Non-compliance can lead to cancellation, even under a "valid until cancelled" consent.
How Instacertify Helps
We confirm your category, prepare documents and the water balance, file on Nivesh Mitra, coordinate the inspection and manage post-consent returns. See our Consent to Operate service.
Frequently asked questions
What is the full form of CTO certificate?
CTO stands for Consent to Operate. It is the permission a State Pollution Control Board gives an industry to start and continue operations under the Water Act, 1974 and the Air Act, 1981.
What is the difference between CTE and CTO?
CTE, Consent to Establish, is needed before you build or expand a unit. CTO, Consent to Operate, is needed before you start production, after the board checks that pollution controls are in place.
Which industries need a CTO?
Industries in the Red, Orange and Green categories need consent. White category industries, which are practically non-polluting, are exempt and only need to inform the board.
What is the validity of a CTO in Uttar Pradesh?
UPPCB has granted CTO for fixed periods by category, typically 5 years for Red, 10 for Orange and 15 for Green. A central amendment in January 2026 provides for consent to remain valid until cancelled, so check how it applies to your unit.
How is the UPPCB consent fee calculated?
It is based on the capital investment of the unit, including land, building, plant and machinery, and on the category of industry.
How do I apply for CTO in UP?
Apply online through the Nivesh Mitra single-window portal, which routes the application to UPPCB, with documents and the fee.
