Leveling the Playing Field: Why Honest Battery Manufacturers Will Win Under New BIS Rules

Have you ever bought an electronic device, expecting the battery to last all day, only to have it die within a few hours? It is a frustrating experience that many consumers face. The gap between what a battery promises on its label and what it actually delivers in real life has been a growing concern in the electronics market. But change is finally on the horizon. The Bureau of Indian Standards (BIS), under the strict guidance of the Ministry of Electronics and Information Technology (MeitY), is stepping in to solve this problem once and for all.

They have recently rolled out vital new implementation guidelines mandating the strict verification of the rated capacity for all portable sealed secondary lithium cells and batteries. If you are a manufacturer, importer, or someone deeply involved in the electronics supply chain, this is a major regulatory shift that requires your immediate attention. At Instacertify, we are breaking down everything you need to know about these new BIS guidelines, ensuring your compliance journey remains smooth, cost-effective, and entirely hassle-free.

Why the Sudden Shift in Regulations?

On February 3, 2026, MeitY issued a pivotal order that changed the landscape for battery manufacturers. The primary driving force behind this official notification was a noticeable and troubling spike in instances where lithium cells and batteries were found to have heavily misdeclared rated capacities. In simpler terms, companies were claiming their batteries had a significantly higher energy capacity than they actually possessed.

This practice not only misleads the end consumer but also creates a highly unfair playing field for honest manufacturers who invest heavily in quality control, accurate testing, and transparent marketing. To safeguard consumer interests and maintain the integrity of the rapidly growing Indian electronics market, regulatory bodies decided it was time to tighten the rules. The focus is no longer just on basic safety—it is now equally about performance accuracy. Consumers have a fundamental right to receive exactly what they pay for, and the government is making sure that misleading, inflated capacity claims are completely eliminated from the ecosystem.

Understanding the New Testing Requirements

So, what exactly is changing in the testing laboratories? Previously, the focus for lithium cells and batteries was predominantly on rigorous safety standards under the Compulsory Registration Scheme (CRS). Now, all portable sealed secondary lithium cells and batteries registered under the IS 16046 (Part 2):2018 standard must undergo a strict verification of their rated capacity.

This verification process isn’t just a simple paperwork update or a self-declaration; it requires physical, standardized, and unbiased testing. According to the new mandate, the battery’s capacity must be measured in strict accordance with Clause 7.3.1 of the IS 16047 (Part 3):2018 / IEC 61960-3:2017 standards. Specifically, this involves a specialized discharge performance test conducted at an ambient, controlled temperature of 20°C.

Once the true, uninflated capacity is measured, it must be accurately reported using the newly modified Unified Test Report Format. Additionally, these new capacity test reports must clearly reference the earlier safety tests conducted under IS 16046 (Part 2), creating a comprehensive, undeniable profile of the battery’s safety and performance capabilities.

Crucial Deadlines for Existing Licensees

Navigating deadlines is often the most stressful part of adjusting to regulatory changes. The BIS has laid out a clear timeline to help the industry transition smoothly without abruptly halting production lines.

For existing licensees whose BIS licenses are valid until April 30, 2027, the mandate is absolute: you must ensure full compliance with the Clause 7.3.1 testing requirements by that exact date—April 30, 2027. If your current license happens to be valid beyond April 30, 2027, you have a slightly different timeline; you are required to comply by the very last date of your license’s current validity.

But what does compliance actually look like in practice? Manufacturers are required to submit third-party laboratory test reports for all their lead models. This involves a multi-step process: generating a formal test request through the Laboratory Information Management System (LIMS), applying online via the Standard Revision or Amendment module on the BIS portal, and submitting a legally binding undertaking that confirms the compliance of all remaining models in your product lineup.

Guidelines for New Applicants

If you are currently in the process of applying for a new BIS license, you also have specific protocols to follow to ensure your products can enter the market. Applications that have already undergone testing may still be processed by the authorities without requiring immediate additional capacity testing.

However, if your application is currently under process right now, you will be required to submit a formal undertaking promising to provide the completed rated capacity test report before the validity of your newly granted license ends.

Keep in mind that after April 30, 2027, the grace period is entirely over—absolutely no new licenses will be granted without the mandatory rated capacity test reporting completed and verified upfront.

Heavy Cost of Non-Compliance

Ignoring these guidelines is simply not an option for any serious business. The consequences of non-compliance are severe and can instantly disrupt your entire business operation. Failure to adhere to the verification mandate and missing the outlined deadlines can lead to the immediate suspension of your highly valued BIS license. Furthermore, authorities hold the power to completely cancel the license or forcefully delete non-compliant battery models from your official scope of manufacturing. Once a model is deleted, selling it in the Indian market becomes a legal violation.

Bigger Picture: Industry Impact and Moving Forward

While these new regulations might seem daunting and administratively heavy at first glance, they represent an incredibly positive step forward for the electronics industry as a whole. By enforcing strict capacity verification, BIS is significantly enhancing consumer trust in electronics sold within India. It actively reduces the influx of substandard, cheaply made products that flood the market and undercut legitimate, quality-focused businesses. Manufacturers who embrace these changes early will find themselves with a stronger brand reputation built on verified reliability and trust.
